Copyright registration is one of the most basic and important registrations a company needs to do, to ensure the ownership and credibility of the product. Apart from that it helps with the protection of your product from being copied by competitors or other copycats.

Who Should Copyright

Copyright serves as a protective shield for a diverse range of creative outputs. The Registrar of Copyrights has structured a detailed register, segmented into six clear categories, each dedicated to particular types of intellectual creations:

  1. Literary Works (Excluding Computer Programs): This division includes various written works like novels, poems, essays, articles, and similar creations.
  1. Musical Works: Items like tunes, song lyrics, and musical notations fall within this category.
  1. Artistic Works: Copyright in this realm covers visual arts like paintings, sculptures, drawings, and similar artistic endeavors.
  1. Cinematography Films: Films and related audiovisual projects enjoy the benefits of copyright protection in this category.
  1. Sound Recordings: Audio recordings, whether they are of music, spoken word, or other sound-driven content, are protected here.
  1. Computer Programs, Tables, and Compilations: The digital world’s cornerstones, such as software, data tables, and compilations, receive their protection in this segment.

Benefits Of Copyright Registration

Registering your work under copyright law offers many benefits for creators and those with intellectual property rights which plays an important role in the use and benefiting from the product. They are:

  • Protection for the Owner: Copyright registration grants owners exclusive rights, including reproduction, distribution, adaptation, sharing, and translation of their work.
  • Strong Legal Protection: Registration ensures that the work cannot be copied without the rightful owner’s permission.
  • Enhanced Brand Image: Holding a registered copyright serves as a representation of ownership and can be used in marketing strategies to improve brand reputation and goodwill.
  • International Protection: Once copyrighted in a specific country, the work is typically granted similar rights in many other countries, including India.
  • Treating Copyright as an Asset: Copyright is considered an intellectual property asset and can be traded, adding a financial dimension to the creator’s portfolio.
  • Increased Visibility for the Owner: Registered works are more prominently showcased, available globally, and easily traceable in copyright databases. This visibility can deter potential unauthorized use.
  • Financial Security: Copyright provides economic resilience by allowing creators to diversify and capitalize on their content, leading to sustained income streams.

Procedure For Copyright Registration

To secure copyright registration online, follow the systematic procedure outlined below:

(1) Submission of Application:  Prepare an application with all required details and a statement of particulars using the designated format (FORM XIV). Note that each individual work requires a separate application. Both the applicant and an Advocate holding a Vakalatnama or a Power of Attorney (POA) must sign each application. Also, make sure to pay the required copyright registration fees.

 (2) Issuance of Diary Number: Once your application is received, the registrar will assign a Diary Number, indicating the start of the registration process. Then, there is a 30-day waiting period to allow for any potential objections.

(3)Handling of Copyright Objections: If no objections arise within the 30-day window, a scrutinizer will assess the application for any inconsistencies. If everything is satisfactory, the scrutinizer proceeds with registration and provides the registrar an extract for the Register of Copyright.

(4)Resolution of Objections: In case objections emerge, both parties involved will receive a notification detailing the objections. A subsequent hearing will be held to address and resolve these concerns.

(5)Application Scrutiny: After the hearing, if necessary, the scrutinizer will conduct a thorough examination of the application. Based on the findings, the application may be approved or declined.

(6) Issuance of Copyright Registration Certificate: Upon approval of the application and payment of copyright registration fees, the corresponding authority will issue the copyright registration certificate. Typically, the entire procedure concludes in around 2 to 3 months.
